4.1 Consent-Based Messaging Only

We send text messages only to individuals who have provided explicit, affirmative consent by checking an optional SMS consent checkbox on one of our forms. We never send unsolicited text messages. Consent to receive SMS is always voluntary and is never required as a condition of submitting any form, completing any purchase, or receiving any service.

4.2 Categories of SMS Messages

We send two distinct categories of text messages, each requiring separate consent:

  • Marketing messages: Promotional offers, event and conference announcements, new program launches, service updates, discounts, and community news from One Percent Better Nation and Keyon Clinton.
  • Non-marketing messages: Appointment reminders, consultation scheduling confirmations, program enrollment notifications, session reminders, application status updates, care coordination messages, and other transactional or account-related alerts.

4.3 No Sharing of SMS Data

No mobile phone numbers, SMS consent records, or opt-in data collected through our forms or platforms will be shared with third parties or affiliates for marketing or promotional purposes. Sharing with operational subcontractors — such as SMS delivery platforms — is permitted solely to the extent necessary to transmit messages on our behalf. SMS opt-in data and consent records are never sold, rented, traded, or otherwise transferred to any third party under any circumstances.

4.4 Opt-Out

You may opt out of all SMS communications at any time by replying STOP to any message received from us. Upon processing your request, you will receive one final confirmation message and no further messages will be sent. To re-subscribe, reply START or re-submit your consent through any active One Percent Better form.

For help with our messaging program, reply HELP to any message or visit our contact page at onepercentbettercommunity.com/contact-us.

4.6 Carrier Disclaimer

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Contact your wireless provider with questions about your text or data plan.

5. How We Share Your Information

We do not sell your personal information. We do not share your personal information with third parties for their own independent marketing or advertising purposes. We may share your information only in the following limited circumstances:

5.1 Service Providers & Operational Partners

We work with trusted third-party service providers who assist in delivering our services, including payment processors, email delivery platforms, SMS messaging providers, website hosting services, video conferencing platforms, customer relationship management systems, and community platform providers. These providers are permitted to access your information only as necessary to perform services on our behalf and are contractually obligated to maintain appropriate confidentiality and security standards.

5.2 Care Coordination

For home care services, we may share relevant health, care plan, and contact information with assigned caregivers, care supervisors, and authorized family members or responsible parties as necessary to deliver appropriate and safe in-home care. This sharing is limited to what is reasonably necessary for care coordination purposes.

5.3 Legal Requirements

We may disclose your information when required to do so by law, regulation, court order, or lawful government request, or when we believe in good faith that disclosure is necessary to protect the rights, safety, or property of One Percent Better, its participants, caregivers, staff, or the public, or to investigate potential violations of our Terms & Conditions.

5.4 Business Transfers

In the event of a merger, acquisition, reorganization, sale of assets, or other business transfer involving any One Percent Better entity, your information may be transferred as part of that transaction. We will provide notice of any such transfer and any material changes to this Privacy Policy that may result.

5.5 With Your Consent

We may share your information with third parties in any other circumstance in which you have provided explicit prior consent to that specific sharing.

6. Health & Sensitive Information

Information collected in connection with home care services — including health conditions, care needs, medical history, and related personal health data — is treated with heightened care. This information is used solely for the purpose of coordinating, delivering, and improving care services and is shared only with those directly involved in providing your care or as otherwise required by law. We do not use health information for marketing purposes.

Caregiver employment application information, including background check data, is used exclusively for employment screening and hiring decisions and is handled in accordance with applicable employment and background screening laws.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to maintain active program, membership, or service relationships, and to comply with our legal, regulatory, and business record-keeping obligations. When information is no longer needed for these purposes, we take reasonable steps to delete, anonymize, or securely dispose of it.

SMS consent records and opt-in documentation are retained for a minimum of four (4) years in compliance with carrier registration requirements and applicable telecommunications regulations.

Care-related records for home care services are retained in accordance with applicable state and federal regulations governing home care providers.
